1. Art of Dessert is a marketplace, not the seller

Art of Dessert is an online venuethat connects independent home-based food makers ("Chefs") with buyers ("Customers"). Art of Dessert does not make, prepare, handle, store, inspect, package, or deliver any food. Each Chef is the independent seller of record and is solely responsible for their products.

2. Chef responsibilities

By listing on Art of Dessert, each Chef represents and warrants that they:

  • Hold and maintain all required permits (California Cottage Food registration or a county MEHKO permit) and food-handler certification;
  • Comply with all applicable food-safety, labeling, allergen, and health laws;
  • Are solely responsible for the safety, quality, accuracy, and legality of their food; and
  • Will indemnify and hold harmless Art of Dessert from any claim, injury, illness, loss, or damage arising from their food or their conduct.

3. Customer acknowledgment & assumption of risk

Food sold on Art of Dessert is made in private home kitchens, not commercial facilities, and is not inspected by Art of Dessert. By ordering, the Customer acknowledges and accepts this, and understands food may contain or be exposed to allergens (including nuts, dairy, eggs, wheat, and soy). Customers with allergies or health conditions order at their own risk and should confirm ingredients directly with the Chef.

4. No warranties

Art of Dessert is provided "as is" and "as available." Art of Dessert makes no warranties of any kind regarding the food, the Chefs, or the platform, and disclaims all implied warranties to the fullest extent permitted by law.

5. Limitation of liability

To the fullest extent permitted by law, Art of Dessert is not liable for any indirect, incidental, or consequential damages, or for any issue arising from food prepared or sold by a Chef. Art of Dessert's total liability, if any, is limited to the amount of fees Art of Dessert actually earned on the transaction at issue.

6. Disputes are between Customer and Chef

Any dispute about an order — quality, safety, fulfillment, or refunds — is between the Customer and the Chef. Art of Dessert may help facilitate communication but is not a party to the transaction.

7. Indemnification

Each user agrees to indemnify and hold harmless Art of Dessert and its operators from claims and damages arising out of their use of the platform or their food, including reasonable attorneys' fees.

8. Governing law

These Terms are governed by the laws of the State of California. Sales are limited to within California.

9. Cookies

We use only essential cookies to keep you signed in and operate the site. We do not use advertising or third-party tracking cookies.
